Yep like the title says I got booted in my own drive way. I have a clean driving record, no tickets nothing outstanding but yet I woke up yesterday morning to find a lovely yellow boot on the back tire of my car and a red tow ticket on the passenger side window. When I went outside and confronted the Officer I said 'What's with the boot on my car for the third time this month?' to which she replies 'Outstanding Unpaid Traffic Tickets going back to 1990.' I said '1990?! I wasn't even old enough to drive in '90! Are you kidding me?!' and she says 'Nope, you have violations and unpaid traffic tickets going back to 1990! You can pay the fines then come and get your car.' I went back inside and used the exact same website the booters use to check license plate numbers for violations,put in my license plate number and came up with 'No outstanding Tickets to date' then I put in my husband's license plate number and got the same message. Heck I even put in the license plate number of my motor bike but it came back clean. I'm fighting this booting as it's been three times each month that I've been booted in my own drive way and the witch says to me 'Your vehicle is parked on a city street there for it is liable to be booted. This whole street belongs to the City.' and I said 'Uhh open your eyes, this is a driveway of a private residence! We are no where near the city street! We're right outside my side door on my property not on the city street. If you do NOT remove that boot in the next five minutes, you're boss will hear from my attorney for harassment. You're doing this because you hate me and want to make trouble. Either get off my property now or I'll have you hauled off by the police.' Well she didn't want to move without the tow truck so I called 9-1-1 and told them I had a trespasser on my property that worked for the city. Police came,assessed the situation and ruled in my favor saying my car and bike were parked in a private drive way that was next to the house and there for the bootings were NOT legal and were to be removed IMMEDIATELY or she faced jail time. She was arrested,the boots were taken off all the cars and my bike and she fought like the devil saying the bootings were legal and that they were parked on a city street in a clearly marked 'No Parking' Zone. I had my Lawyer draw up harassment papers against the witch stating all she does is patrol the neighborhood and target cars parked in residential drive ways and no where on my street is there a no parking sign or a tow away zone sign and I've lived on the same street for a year and I've yet to see the sings that say 'No Parking' and "Tow Away Zone'

Unfortunately now I have a court date in three weeks to speak to her charges of Brutality against a City Employee. I never touched her or her partner. I walked away and called my attorney at home and had him draw up papers that were filed first thing this morning. They claim my husband who wasn't even home at the time,came at them with a knife. My husband was working the Grave Yard shift for the third month in a row and was at work when they came around to boot the car.
How can a man be on the other side of the city working the Grave Yard Shift and be home allegedly attacking the City Parking People at the same time?

Hubby has a swipe card he swipes and a pin code that he uses to clock in at work. Once the card is swiped and the pin number inputted he gets a print out stating what time he showed up for work, when his break times are and what time he went home and on this day he came home two hours AFTER the Parking Authority was told to leave the premises.
They were gone,the tow truck was gone and the boot and red flag were all gone. I was on the phone with my Lawyer drawing up harassment papers which were served at exactly 8 A.M. Monday morning to the witch who patrols the neighborhood stating that the residents of my neighborhood were fed up with her booting their cars which are legally parked on a dead end street in their drive ways that do NOT belong to the city but to the respective homeowner.
Until our next court date in August, the City Parking Authority is barred from roaming up and down streets at will checking license plate numbers for violations and if they are caught in residential neighborhoods the parking authority WILL have to pay a hefty fine and the employees who willfully ignore the restraining orders will be prosecuted to the fullest extent of the law and they don't like it.
They're claiming it takes away from them doing their jobs...yeah I get that but they wait until it's dark to start patrolling the neighborhoods for vehicles to boot when everyone is in bed sleeping,they'll call the tow truck,have the vehicle towed and leave a notice for the person whose car they towed to pay the outstanding violations or fight a long fight. I chose to fight as has every person on my street from corner to corner around the block and back again.

I have another court date in mid August to settle this dispute once and for all.
I have the entire neighborhood's support behind me and they joined the lawsuit making it a Class Action Harassment Suit something the Parking Authority doesn't want any thing to do with.
We're all tired of the Parking Authority sneaking around under the cover of night booting then towing peoples cars to the impound lot over $20.00 or as one lady told me 'A ticket my deceased brother settled back in 1958! My stupid brother-god rest his soul where ever he was laid to rest during the Nam/Korea Conflict-borrowed my car to go to over the Golden Gate Bridge for one last hurrah before he shipped out and left my car in a tow away zone! He paid all the tickets except one that was lost in a wind storm so it wasn't paid until he came home on leave. I got it in the mail and he paid it right before he shipped back out again. Now they're claiming they have no record of those tickets being paid but I have proof beyond proof that they were all paid! But it's not good enough for them. Oh no they want to talk to him in person and get this settled. How do you talk to a dead man? He was shot point blank between the eyes! He never came home!'

My lawyer called and said that the Parking Authority doesn't want to fight a big court battle and is willing to settle with everyone on the street that has been booted illegally by the Night Patrol as they call themselves. Don't know if I want to take the settlement or duke it out in court.
It's cheaper not to go to court, though i understand the whole 'it's the principle of the thing' mentality. they've been bitten so they'll be twice shy about being stupid in future...if they even dare try again! :)

Knowing 'Darius' and 'Dannica' they'll be back in three months to try again they're too stupid to understand 'Stay the hell out of private neighborhoods' and 'operate only during the day and use the computer and double check the license plate numbers BEFORE you boot not after!'

There are about seven or eight people who aren't backing down and have refused the settlement so I'm not backing away. I'm standing my ground,I was booted in my own private drive way.

After what I just went through I'm happy hubby and I got a huge settlement and are moving to a bungalow we paid 117,500 for. The House Inspector's coming with papers tomorrow then we have to do some more stuff on Friday,start packing up,see the Lawyer again next week,continue to pack and get the heck out of here.
I also got another settlement a rather LARGE settlement because the house hubby and I are so desperately in love with--our old Victorian--isn't worth the amount of money needed to sink into it to bring it up to safety code, according to our new house inspector and city inspector who is a nice guy there's asbestos in every nook and cranny.
Basically Victoria (our old house) isn't safe for human inhabitants to live in. So the city sued the former owners and got a settlement they passed onto us that we used to buy our beautiful bungalow that has a beautiful front and back yard for our babies to run in without the fear of dogs trying to go after them in their own yard. I'm especially happy to move as I'd like to put up the pool I bought last year but was told 'If you want to put up your pool then it'll have to be put up where all the neighborhood kids can have access to it. other wise it's too deep!' We bought a cute wooden table with two chairs at LobeLaws to put out on the lawn, a few days later the Janitor comes strolling by and says 'You'll have to take that down and put it away! It's ruining the patio!' WHAT PATIO? That uneven piece of crap out back that floods every time it rains? THAT'S A PATIO?! Suure what ever they say.

The house is great,the yards (gotta learn to spell...yeesh I was the top speller all my life and here I am goofing on words like yard!) are terrific, my older brother in law's gonna build a fence to keep the babies in the back yard and on around the bbq pit for their safety and one in the front yard so they won't run into the street, my older brother after closing is going to install puppy doors for them to wander in and out of the house and into their new yards. Now we have to pare down and pack what we want to keep and ditch the rest.
Good bye thirteen stairs up and eleven stairs to the basement! Bye bye to hearing 'if you want to put up the pool you'll have to put it up in the common area for all the kids to play in' and 'you'll have to put that lawn set away! It's ruining the grass!' bye bye to $879.00 every month! Gotta call the cable company and have them re-install the cable in the bedrooms,living room and kitchen and hook my internet back up then it's the phone company to turn off the land line here and hook it back up at the new house and change the billing address on the cell phone bills, mail the card for the vet telling them we're moving,change my address on ebay and paypal and on domino's website,tell the elderly guy that gives us eggs for $5.25 we're moving,tell the idiots at the clinic we're moving and get a new lab slip....oh yay 90 some degree heat and in July I have to have blood work done! Always my most fave job in the world in the summer....NOT! I can do without!
